Spot Protected Concerted Activity Before You React

Identify when employee conduct may be protected concerted activity before choosing a response.

Principle line: Do not manage tone before you classify the protected right. What the framework protects Section 7 analysis starts with two questions: is the conduct concerted, and is it for mutual aid or protection? Concerted does not always mean a formal union campaign; it can be employees acting together, one employee speaking for others, or a group complaint about wages, schedules, staffing, safety, or other working conditions.
